A Texas appellate panel on Wednesday affirmed the dismissal of a suit seeking to hold Kansas City Southern Railway Co. liable for a railroad conductor’s heart attack death, saying the company’s adoption of certain workplace safety policies didn’t mean it voluntarily assumed a higher duty of care.
