A D.C. Circuit panel affirmed Friday the Surface Transportation Board’s finding that Norfolk Southern Railway Co. isn’t immune from antitrust claims lodged by CSX Transportation Inc. regarding a small railroad the pair co-owns in southern Virginia, stripping Norfolk Southern of a possible future defense to the lawsuit.
